SI – Studio Inzaghi, with a team led by Managing Partner Guido Alberto Inzaghi and Partner Tommaso Fiorentino, assisted Risanamento S.p.A. (formerly Milano Santa Giulia S.p.A.) before the Council of State, in defense of the Arena Santa Giulia and the amendment to the Montecity-Rogoredo Program Agreement, obtaining the dismissal of the appeal filed by Forumnet, the owner of the Mediolanum Forum in Assago.
Forumnet’s appeal contested, in particular, the classification of the Arena Santa Giulia as a “work of public and general interest,” alleging undue economic and urban planning advantanges in favor of Risanamento/Santa Giulia, as well as the lack of adequate parking provisions and assessment of traffic impacts associated with the new structure.
The Council of State upheld the full legitimacy of the urban planning decisions made by the Municipal Administration, reaffirming that the Arena is a strategic infrastructure for the Milan-Cortina 2026 Winter Olympics, where it is set to host ice hockey. Due to its size and potential, the Arena guarantees a lasting contribution to the community, strengthening services throughout the neighborhood well beyond the Olympic Games.
The ruling also clarified that the Municipal Administration acted with full reasonableness in assessing the costs and benefits of the Program Agreement, rejecting Forumnet’s claims regarding the alleged unlawfulness of the urban planning benefits granted to the Arena. On the contrary, the Council of State positively evaluated the Municipality’s discretion not to acquire public ownership of the facility.
This latest administrative court ruling brings an end to the dispute concerning the urban development project that led to the approval of the Santa Giulia Arena and the amendment to the Montecity – Rogoredo Program Agreement. It follows the recent ruling of the Council of State in March 2025, in which SI – Studio Inzaghi assisted Risanamento S.p.A. in the dismissal an appeal filed by the company Immobiliare Ametista.
